1 Generally
1.1 Fullmaktskollen i Sverige AB is owned by Insurance Sweden and the Swedish Insurance Brokers' Association and has been formed in cooperation with the Swedish Pensions Agency. The mission of the company is to develop, administer and manage the daily operation of fullmaktskollen.se on a non-for-profit basis. The purpose of fullmaktskollen.se is, within the area of life and pension insurance, to provide an overview and control to individuals and employers who grant powers of attorney. At the same time, administering powers of attorney is made more efficient and secure.
1.2 By using fullmaktskollen.se, those of you who grant powers of attorney can simply and easily:
1.3 The organisation approves these User Terms and Conditions and undertakes to comply with them by registering the organisation with fullmaktskollen.se.
2 Registration of the organisation
2.1 A company signatory or other authorised representative, i.e. a person who has been instructed by the company signatory to issue a power of attorney on behalf of the organisation within the area of life and pension insurance, shall confirm registration of the organisation on fullmaktskollen.se. Confirmation can be given as soon as an agent has uploaded a power of attorney for signature for the relevant organisation. The signature must at all times be that of the company's signatory or other authorised representative set forth in the power of attorney by the agent. It is only the agent who has a connection agreement with Fullmaktskollen i Sverige AB who can post powers of attorney for registration on fullmaktskollen.se. Fullmaktskollen i Sverige AB shall not conduct any authorisation verifications regarding the person or persons who have been identified as company signatories or other authorised representative or of the persons, hereinafter referred to as "users", who have been allocated authorisation in accordance with the provisions below.
2.2 An organisation may only use fullmaktskollen.se in accordance with these User Terms and Conditions and instructions issued by Fullmaktskollen i Sverige AB.
2.3 In conjunction with registration and use of the services on fullmaktskollen.se, the user must log on with a Swedish digital ID.
3 Allocation of authorisation
3.1 Authorisation is allocated in conjunction with registration and may thereafter be regularly adjusted as set forth below. User authorisation may be registered on three levels:
- representative (company signatory or other authorised representative)
- head administrator
- administrator
3.2 Users shall have the following powers:
A representative is authorised to:
- sign a new power of attorney
- revoke a power of attorney
- change the period of validity of a power of attorney
- state limitations for which individuals are covered by the power of attorney
- terminate registration on fullmaktskollen.se
- change how they themselves receive notifications
- add new users or remove registered users
A head administrator is authorised to:
- revoke a power of attorney
- change the period of validity of a power of attorney
- state limitations for which individuals are covered by the power of attorney
- change how they themselves receive notifications
- add new users or remove registered users
An administrator is authorised to:
- add persons to, and remove persons from, a registered power of attorney
- change how they themselves receive notifications
3.3 In conjunction with registration of a user or a change of a user's authorisation, the user must log on with their Swedish digital ID and confirm the relevant authority. In order to sign a new power of attorney, it is at all times required that the agent who posted the relevant power of attorney for signature provides the name of the relevant representative. Only the representative set forth in the power of attorney may sign the relevant power of attorney.
4 Registration of powers of attorney
4.1 A power of attorney may be registered with Fullmaktskollen i Sverige AB in two ways:
a) A representative of the organisation signs a digital power of attorney which the agent has posted for the relevant organisation to be signed by the named representative. It is to be signed with a Swedish digital ID.
b) A signatory or other authorised representative of the organisation signs a standardised paper version of a power of attorney produced by Fullmaktskollen i Sverige AB. The power of attorney is subsequently scanned and registered on fullmaktskollen.se.
5 Communications
5.1 Communications from fullmaktskollen.se are sent to the organisation's registered user via e-mail or SMS. In the settings, the user indicates which messages are to be sent to the user and is responsible for ensuring that contact information and communication settings are updated. The contact information and settings are updated under Mina inställningar (currently in Swedish only). Communications may relate to new powers of attorney to be signed or changes to existing, applicable powers of attorney.
6 Processing of personal data
6.1 Fullmaktskollen i Sverige AB processes your personal data, your name, your personal identification number, your e-mail address and your mobile telephone number on fullmaktskollen.se. Fullmaktskollen also processes the personal data stated in your powers of attorney.
Fullmaktskollen i Sverige AB is the data controller for the personal data provided by you when you registered with fullmaktskollen.se, e.g. your contact information. The same also applies to personal data provided to Fullmaktskollen i Sverige AB by companies and organisations connected to fullmaktskollen.se.
The agent is the personal data controller for the personal data which is used in powers of attorney and revocations. This means that, when Fullmaktskollen uses your personal data in powers of attorney and revocations, it is on behalf of the person who is the personal data controller.
All processing of personal data takes place in accordance with applicable legislation. The purpose of processing is to be able to provide the service. Personal data may be transferred to organisations within the area of life and pension insurance who are connected to fullmaktskollen.se by virtue of an agreement, and to Fullmaktskollen i Sverige AB's subcontractors in order to be able to maintain operation of the service.

7 Disclaimer of liability
7.1 Normally, you shall be able to use fullmaktskollen.se 24 hours a day, 7 days a week. However, Fullmaktskollen i Sverige AB shall not be liable for any operational disruptions or outages.
7.2 In addition, Fullmaktskollen i Sverige AB is not liable for faults or damage resulting from the fact that a communication has not been received or is not received on time or for faults or damage which is incurred as a consequence of the fact that the organisation, other principals connected to fullmaktskollen.se, or third parties provide incorrect or delayed information.
7.3 Fullmaktskollen i Sverige AB shall not be liable for damage or problems which may affect an organisation which uses fullmaktskollen.se and which are due to operational outages or other disruptions to telephones, computers or other communications.
7.4 Links from fullmaktskollen.se to other websites constitute nothing more than an information service. Fullmaktskollen i Sverige AB is not responsible for the material or information on such websites.
7.5 Fullmaktskollen i Sverige AB's liability in damages shall be limited to damage which Fullmaktskollen i Sverige AB negligently causes to an organisation by breaching any provision of these User Terms and Conditions or applicable laws and statutes. Fullmaktskollen i Sverige AB shall not be liable under any circumstances for damage due to disruptions in the availability of the service or where any unauthorised individual uses the fullmaktskollen.se service except where Fullmaktskollen i Sverige AB has acted with gross negligence.
7.6 Fullmaktskollen i Sverige AB's liability in damages shall be limited in any event to direct damage and to an aggregate amount of one-fourth of a statutory price base amount in accordance with the Swedish Social Insurance Code (Swedish Code of Statutes 2010:110). Fullmaktskollen i Sverige AB shall not be liable for indirect damage, e.g. loss of profit or loss of information.
8 Rights connected to fullmaktskollen.se
8.1 All rights connected to fullmaktskollen.se belong to Fullmaktskollen i Sverige AB. By registering an organisation on fullmaktskollen.se, the organisation is entitled to use the services on fullmaktskollen.se in accordance with these User Terms and Conditions.
9 Unregister from fullmaktskollen.se
9.1 A company signatory or other authorised representative of the organisation may at any time unregister the organisation from fullmaktskollen.se by logging onto fullmaktskollen.se. In conjunction with deregistration, all applicable powers of attorney for the organisation which have been registered via fullmaktskollen.se will be revoked by a representative or head administrator. A notice of deregistration will be sent to all of the organisation's registered users.
10 Operation and maintenance
10.1 Fullmaktskollen i Sverige AB shall be entitled to limit access to fullmaktskollen.se due to development work, maintenance or for operational reasons. Fullmaktskollen i Sverige AB shall strive to minimise downtime and to take measures to mitigate to the extent possible the damage incurred by parties who grant powers of attorney and Fullmaktskollen i Sverige AB’s principals. To the extent possible, Fullmaktskollen i Sverige AB shall inform the organisation and principals regarding planned outages.
11 Changes to the services in fullmaktskollen.se
11.1 Fullmaktskollen i Sverige AB shall be entitled to implement changes to the services in fullmaktskollen.se. Information regarding changes shall be provided on www.fullmaktskollen.se.
12 Winding up of fullmaktskollen.se
12.1 Fullmaktskollen i Sverige AB may wind up fullmaktskollen.se in whole or in part. In such cases, users shall be notified in ample time, not later than two months prior to winding up.
13 Supplements and amendments to the User Terms and Conditions
13.1 Fullmaktskollen i Sverige AB shall be entitled to implement supplements and amendments to these User Terms and Conditions. Fullmaktskollen i Sverige AB shall send notice to administrators regarding such supplements and amendments. In the event the amendments are minor, however, Fullmaktskollen i Sverige AB shall not be required to give any notice.
14 Applicable law
14.1 These User Terms and Conditions shall be interpreted and applied in accordance with Swedish law.
