1 Generally
1.1 Fullmaktskollen i Sverige AB is owned by Insurance Sweden and the Swedish Insurance Brokers' Association and has been formed in cooperation with the Swedish Pensions Agency. The mission of the company is to develop, administer and manage the daily operation of fullmaktskollen.se on a non-for-profit basis. The purpose of fullmaktskollen.se is, within the area of life and pension insurance, to provide an overview and control to those of you who grant powers of attorney. At the same time, administering powers of attorney is made more efficient and secure.
1.2 By using fullmaktskollen.se, those of you who grant powers of attorney can simply and easily:
1.3 As the grantor, you approve these User Terms and Conditions and undertake to comply with them by registering with fullmaktskollen.se.
2 Log on to fullmaktskollen.se
2.1 In order to view and administer your powers of attorney at fullmaktskollen.se, log on with your Swedish digital ID.
3 What you can do on fullmaktskollen.se
3.1 In the settings on fullmaktskollen.se, you provide your e-mail address or your mobile telephone number. You will receive messages from fullmaktskollen.se via e-mail or SMS. Fullmaktskollen.se is not responsible for ensuring that these messages reach you.
3.2 You can sign, revoke and change the period of validity of your powers of attorney. The aforementioned applies both to powers of attorney which you have uploaded directly on fullmaktskollen.se and paper versions of powers of attorney which you have signed and which have been registered on fullmaktskollen.se by the organisation you have authorised with the power of attorney (the “agent”).
3.3 The agent to whom you have granted a power of attorney posts your power of attorney in the register and can see if you have signed it. A signed power of attorney will also be displayed electronically for insurance companies and other parties of whom you are, or are in the process of becoming, a customer. The person to whom you have granted the power of attorney states who can view your power of attorney.
3.4 The agent to whom you have granted a power of attorney may notify Fullmaktskollen i Sverige AB that the power of attorney is no longer valid. This might happen, for example, when someone you have engaged has concluded their assignment. You will then receive a message that the power of attorney no longer applies.
4 How Fullmaktskollen.se processes your personal data
4.1 Fullmaktskollen i Sverige AB processes your personal data, your name, your personal identification number, your e-mail address and your mobile telephone number on fullmaktskollen.se. Fullmaktskollen also processes the personal data stated in your powers of attorney.
Fullmaktskollen i Sverige AB is the data controller for the personal data provided by you when you registered with fullmaktskollen.se, e.g. your contact information. The same also applies to personal data provided to Fullmaktskollen i Sverige AB by companies and organisations connected to fullmaktskollen.se.
The agent is the personal data controller for the personal data which is used in powers of attorney and revocations. This means that, when Fullmaktskollen uses your personal data in powers of attorney and revocations, it is on behalf of the agent who is the personal data controller.
All processing of personal data takes place in accordance with applicable legislation. The purpose of processing is to be able to provide the service. Personal data may be transferred to organisations in the life insurance and pensions area who are connected to fullmaktskollen.se by virtue of an agreement, and to Fullmaktskollen i Sverige AB's subcontractors in order to be able to maintain operation of the service.

5 Disclaimer and damages
5.1 Normally, you shall be able to use fullmaktskollen.se 24 hours a day, 7 days a week. However, Fullmaktskollen i Sverige AB shall not be liable for any outages.
5.2 Organisations in the life insurance and pensions area who wish to connect to fullmaktskollen.se are contractually bound to comply with the requirements and terms and conditions established by Fullmaktskollen i Sverige AB. Fullmaktskollen i Sverige AB shall be responsible for following up on compliance with the requirements and terms and conditions.
5.3 Fullmaktskollen i Sverige AB shall not be liable for any direct or indirect damage or loss which those of you who grant powers of attorney may incur in connection with, or due to, your use of fullmaktskollen.se.
5.4 Fullmaktskollen i Sverige AB shall not be liable for damage or problems which may affect those of you who use fullmaktskollen.se and which are due to operational outages or other disruptions to telephones, computers or other communications.
5.5 Fullmaktskollen i Sverige AB shall not be liable for faults or problems relating to digital identification or similar which you have received from third parties.
5.6 Links from fullmaktskollen.se to other websites constitute nothing more than an information service. Fullmaktskollen i Sverige AB is not responsible for the material or information on such websites.
5.7 Fullmaktskollen i Sverige AB's liability in damages to those of you who grant powers of attorney on fullmaktskollen.se shall be limited to damage which Fullmaktskollen i Sverige AB causes to you by breaching any provision of these User Terms and Conditions or applicable laws and statutes. Fullmaktskollen i Sverige AB shall not be liable for damage due to disruptions in the availability of the service.
5.8 Fullmaktskollen i Sverige AB's liability in damages to those of you who grant powers of attorney on fullmaktskollen.se shall be limited to direct damage and to an aggregate amount of one-fourth of a statutory price base amount in accordance with the Swedish Social Insurance Code (Swedish Code of Statutes 2010:110). Fullmaktskollen i Sverige AB shall not be liable for indirect damage, e.g. loss of profit or loss of information.
6 Your liability as a grantor
6.1 In order for you to be able to use fullmaktskollen.se, you need services from other providers, e.g. e-mail, internet and mobile telephony services. You shall be responsible for ensuring that you have access to these services.
6.2 You are responsible for registering your e-mail address or your mobile telephone number on fullmaktskollen.se and to ensure that the information is updated. It is you to whom we shall send all information regarding your powers of attorney.
6.3 You shall be responsible for the information you provide when you register on and use fullmaktskollen.se. Fullmaktskollen i Sverige AB is not responsible for any consequences of your provision of incorrect information.
6.4 You may only use fullmaktskollen.se in accordance with these User Terms and Conditions and applicable statutes and decisions by governmental authorities. You shall also be obliged to comply with the instructions regarding fullmaktskollen.se provided to you by Fullmaktskollen i Sverige AB via e-mail or SMS.
6.5 You must store your Swedish digital ID in a secure manner. Fullmaktskollen i Sverige AB shall not be liable for the consequences resulting from use of your Swedish digital ID by an unauthorised party.
7 Responsibilities of other organisations
7.1 Organisations within the area of life and pension insurance who are connected to fullmaktskollen.se shall be responsible for complying with the requirements and terms and conditions set forth in the agreement between Fullmaktskollen i Sverige AB and the respective organisation.
8 Rights connected to fullmaktskollen.se
8.1 All rights connected to fullmaktskollen.se belong to Fullmaktskollen i Sverige AB. By registering on fullmaktskollen.se, you are entitled to use the services on fullmaktskollen.se in accordance with these User Terms and Conditions.
9 Unregister from fullmaktskollen.se
9.1 You may unregister from fullmaktskollen.se at any time. You may do so by logging on to fullmaktskollen.se. If you wish to unregister, you must first revoke all applicable powers of attorney you have granted.
10 Operation and maintenance
10.1 Fullmaktskollen i Sverige AB shall be entitled to limit access to fullmaktskollen.se due to development work, maintenance or for operational reasons. Fullmaktskollen i Sverige AB shall strive to minimise downtime and to take measures to mitigate to the extent possible the damage incurred by those of you who grant powers of attorney and all other connected parties. To the extent possible, Fullmaktskollen i Sverige AB shall inform you and other connected parties regarding planned outages.
11 Changes to fullmaktskollen.se
11.1 Fullmaktskollen i Sverige AB shall be entitled to implement changes to fullmaktskollen.se. Information regarding changes shall be provided on www.fullmaktskollen.se
12 Winding up of fullmaktskollen.se
12.1 Fullmaktskollen i Sverige AB may wind up fullmaktskollen.se in whole or in part. In such cases, those of you who grant powers of attorney and other parties shall be notified in ample time, not later than two months prior to winding up.
13 Supplements and amendments to the User Terms and Conditions
13.1 Fullmaktskollen i Sverige AB shall be entitled to implement supplements and amendments to these terms and conditions. Fullmaktskollen i Sverige AB shall notify those of you who grant powers of attorney regarding such supplements and amendments via the e-mail address or the mobile telephone number you have registered. In the event the amendments are minor, however, we shall not be required to notify you.
14 Relevant laws apply
14.1 These User Terms and Conditions shall be interpreted and applied in accordance with Swedish law.
